Delegate terms and conditions

Please read these terms and conditions carefully and make sure you understand them before you complete your booking. We recommend that you save a copy of these terms and conditions for future reference. These terms and conditions together with the registration form and privacy policy govern the agreement between the Client and OEUK in connection with the booking of and attendance at the Event whether such Event takes place at a physical venue or digitally, including via website or teleconference or via any other electronic means.

1. Definitions

In these terms and conditions the following terms shall have the following meanings:

1.1. “Client” means the person or company making the booking as set out in the Registration Form;

1.2. “Content” means any materials, handouts, slides or presentations which are issued to Delegates as part of the Event;

1.3. “Delegate” means the individual in whose name the booking is made whether the booking was made directly by the individual or on the individual’s behalf by a 3rd party;

1.4. “Event” means the Event stipulated on the Registration Form which may be an “in-person” Event or “virtual”;

1.5. “Event Venue” means the physical location where the Event is held as notified by OEUK in advance of the Event;

1.6. “Member” any Client who is a member of OEUK and has paid their current membership fee in full at the time of booking the Event;

1.7. “OEUK” means The UK Offshore Energies Association Limited (trading as Offshore Energies UK), having its registered office at 1st Floor, Paternoster House, 65 St Paul’s Churchyard, London, EC4M 8AB, (Company Number 01119804);

1.8. “Registration Form” means the online form to be completed by the Client in order to book and pay for a place at an Event;

2. Bookings and Payment

2.1. Orders placed with OEUK shall constitute a contract when the Client books and pays directly through our online facilities and the booking has been confirmed by OEUK. Payment is required at the time the booking is made. Payment can be made either by credit or debit card on the OEUK’s website/online facility. You will be sent joining instructions via email. If you have not received joining instructions 24 hours prior to the Event please contact events@oeuk.org.uk.

2.2. Bookings may be made up until the day before the Event. For any booking made within two days of the Event, a delegate’s name and company may not be included on any delegate list.

2.3. A booking is strictly for the person named on the registration form. Should a Delegate be unable to attend the Event, OEUK will be under no obligation to provide a refund or credit note however, OEUK may, in its sole discretion, transfer the booking to an alternative delegate.

2.4. The Company endeavours to cater for all Delegates, however, should a Delegate have any special needs or requirements the Delegate should contact the Company with details of their requirements no later than one week prior to the Event. Please contact events@oeuk.org.uk with any special needs or requirements.

2.5. Where the Client is making a booking for an Event on behalf of a Delegate or multiple Delegates, such Delegate(s) will be bound by these terms and conditions and the Client agrees to procure their compliance with the same.

3. Reduced Rate / Promotional Rate

3.1. OEUK offer a reduced rate to Members for some Events. In order to receive the reduced rate, the Client must be an OEUK member at the date of booking and have already paid your current membership in full. If the Client’s membership has not been paid they will need to pay the non-member rate in order to register for the event. The reduced rate cannot be applied to a booking once payment has been made.

3.2. OEUK may offer a promotional rate for some Events. The promotional rate will be advertised on the OEUK website and may be notified via marketing materials for the Event.

4. Attendance at the Event

4.1. Whilst attending an Event the Client and Delegate(s) will comply with:

4.1.1. all applicable law, including (but not limited to) all health and safety legislation and requirements;

4.1.2. all instructions given by OEUK or on OEUK’s behalf including (but not limited to) in relation to any security arrangements; and

4.1.3. the terms and conditions of the Event Venue.

4.2. OEUK reserves the right to refuse admission and to remove any Delegate from the Event for any reasons which, in the sole opinion of OEUK, are necessary.

5. Substitutions & Cancellations

5.1. The Client or Delegate shall not be entitled to cancel the booking or receive a refund of any payment after the booking has been confirmed.

5.2. OEUK reserve the right to make changes to the published programme of an Event, or vary, cancel, reschedule or amend the timings of the Event.

5.3. In the event of it being found necessary, for whatever reason, that the Event is postponed or the dates are changed, OEUK shall not be liable for any expenditure, damage or loss incurred by the Client or the Delegate.

5.4. Where OEUK is required to cancel or reschedule the Event, OEUK will honour the booking for the rescheduled date and the booking between the Delegate and OEUK shall remain in force.

5.5. Where the Event will not be rescheduled OEUK will issue a full refund. Liability will be limited to the amount of the fee paid by the Client or Delegate. The Client acknowledges that this shall constitute the sole remedy, and OEUK’s only liability to the Client, in such circumstances.

6. Photography & Filming

6.1. Save where the Company’s prior written consent has been obtained, the use of photographic equipment is not allowed. All other recordings and any transmission are prohibited including, without limitation, recording of any data, information or results of or relating to the event and any participant. As a condition of entry to the Event, you assign the copyright of any photographs or recordings you make at the event to the company.

6.2. Events may be recorded and photographed by OEUK or notes taken of discussions during the Event may be made by the Company. Delegates who do not wish to be filmed should advise OEUK in advance of the Event by e-mail to events@oeuk.org.uk.

7. Data Protection

7.1. We will use any personal data you provide to us in connection with your registration and attendance at the Event in accordance with our privacy policy which can be found here: https://oeuk.org.uk/privacy-policy. You will make available to Delegates or other data subject(s), whose personal data you keep, a copy of or the link to our privacy policy.

7.2. Where a Client makes a booking on behalf of any Delegate, the person completing the registration warrants that he/she has authority to do so.

8. Speakers

8.1. Views expressed by the speakers are their own and OEUK accepts no liability for any loss, injury or damage, howsoever caused, to the bearer except where the loss, injury or damage is caused by the negligence of the Company, its employees or its agents.

9. Insurance & Liability

9.1. It is the responsibility of the Delegate to arrange appropriate insurance cover in connection with their attendance at the Event. OEUK cannot be held responsible for any loss, liability or damage to personal property.

9.2. Nothing in these Terms and Conditions shall limit OEUK’s liability for death or personal injury resulting from OEUK’s negligence or for any other liability which cannot be excluded by law.

9.3. Subject to 9.2, OEUK shall not be liable for (i) loss of profits; (ii) loss of business; (iii) depletion of goodwill and/or similar losses; (iv) loss of anticipated savings; (v) loss of goods; (vi) loss of contract; (vii) loss of use; (viii) loss due to corruption of data or information; (ix) any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses; (x) inaccuracies in Content or unavailability of Content or delay in delivery of Content; or (xi) loss or corruption of data ((i) to (x) together being “Losses”), whether or not we were advised of the possibility of such loss by you, any Delegate or any third party.

9.4. Our maximum aggregate liability in contract, tort, or otherwise (including any liability for any negligent act omission) howsoever arising out of or in connection with the performance of our obligations under the terms and conditions shall be limited to a sum equal to the amount of the price paid.

10. Miscellaneous

10.1. The registration form, terms and conditions and our privacy policy constitute the entire agreement between the parties and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between the parties, whether written or oral, relating to its subject matter.

10.2. Both parties agree that they shall not have any remedy in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in the registration form, terms and conditions and privacy policy, and further that they shall have no claim for innocent or negligent misrepresentation based on any statement in the registration form, terms and conditions and privacy policy.

10.3. We may assign, mortgage, charge, subcontract, delegate or declare a trust over any or all of our rights and obligations under the terms and conditions to or for the benefit of any person (including a natural person, corporate or unincorporated body (whether or not having separate legal personality)). You shall not assign, transfer, mortgage, charge, subcontract, delegate, declare a trust over or deal in any other manner with any of your rights and obligations under the terms and conditions without our prior written consent.

10.4. In the event of any inconsistency, conflict or ambiguity between the terms and conditions and any terms and conditions stated on the registration form, the provisions of these terms and conditions shall apply.

10.5. These terms and conditions are governed by English Law.
